AFPM President Charles T. Drevna has issued the following statement on a report by the EPA’s Office of the Inspector General:
‘We are pleased that the EPA Office of Air and Radiation has agreed to implement the recommendations of EPA’s Inspector General, however, AFPM remains sceptical about the final outcome given the Agency’s noted lack of urgency and transparency in the promulgation process. EPA has proposed regulations for a Quality Assurance Plan to address fraud in the RFS, yet obligated parties still face uncertainty because the Agency has failed to act in a manner that provides market stability. While we support the Agency’s initiative to provide an affirmative defence for liability stemming from invalid RFS credits, as proposed, it is an overly expensive, complex, and burdensome due diligence program that fails to restore liquidity to RFS credits called Renewable Identification Numbers (RINs).’
